The forensic medical opinion

A medico legale specialist certifies the percentage of permanent biological damage, the days of temporary incapacity and the causal link. That certificate is the engine of the claim: insurers negotiate against it, and courts start from it.

We instruct specialists we know and trust in the relevant discipline, and we never open negotiations before the impairment has stabilised — settling early is the most expensive mistake an injured foreigner makes.

Medical malpractice under the Gelli-Bianco framework

Claims against hospitals and clinics follow a mandatory route: a technical preliminary assessment (ATP) or mediation before any trial, with a court-appointed panel of experts. Public facilities carry a ten-year contractual limitation; claims against an individual practitioner are usually five.

We handle birth injury, surgical error, delayed and missed diagnosis, and infection claims, including cases where the treatment happened in Italy and the consequences are being managed in the United States.

Deadlines that end cases

Two years for a road-traffic claim. Five years for general tort. Ten for contractual liability, including most hospital claims. Cruise and airline claims can be far shorter and are governed by their own conventions.
