Every transaction in Italy runs through a single identifier, and Americans discover it at the worst possible moment — usually a week before a closing, when the notary asks for it and nobody has one.
The codice fiscale is Italy's tax identification number. It is not a tax registration in the sense an American would assume: having one creates no obligation to file anything and no liability in itself. It is simply the string that identifies you to every Italian public system.
What it is needed for
- signing a notarial deed to buy or sell property
- incorporating a company, or being appointed a director
- accepting an inheritance and filing the succession declaration
- opening a bank account
- signing a lease, or putting utilities in your name
- registering a vehicle
- receiving healthcare and enrolling in the national service
If you are doing anything in Italy that leaves a record, you need one. Note that a company also needs its own — for a foreign entity that will hold Italian assets or shares, the entity itself is registered.
What it actually is
Sixteen characters generated from your surname, first name, date and place of birth, and sex, with a final check character. Because it is derived from your data, it is deterministic — which leads to a common misunderstanding.
You will find websites that "calculate" your codice fiscale. The string they produce may well be correct, but a calculated code has no legal existence: it has not been issued, so it is not in the Agenzia delle Entrate register, and every counter that checks it will reject it. What you need is the certificate of attribution.
The three ways to obtain one
Through the Italian consulate covering your US state. You apply with your passport and the consulate's form. It is the standard route and it works; the timing depends entirely on the consulate's backlog, which varies from days to several weeks.
Through a representative in Italy, acting under a power of attorney. This is what we normally do for clients, because it is faster and because we are usually obtaining several documents at once. It is also the route that works when you are not in a position to attend a consulate.
In person in Italy, at any office of the Agenzia delle Entrate. Quick — often the same day — but it requires you to be there, which for most of our clients is the thing we are trying to avoid.
Where applications go wrong
Four recurring problems, all avoidable.
Name mismatches. The code is generated from your name exactly as it appears on your passport. Middle names, hyphenated surnames and married names all cause trouble when the application form and the passport do not match character for character.
Place of birth. For those born outside Italy the code encodes the country of birth. An application that gives a US city without the correct country coding produces a rejected or duplicated record.
Duplicates. If you have Italian ancestry, or spent time in Italy years ago, you may already have a code. Applying again creates a duplicate, and duplicates take longer to unwind than the original application took to file.
Corporate applicants. A US entity applying needs its incorporation documents apostilled and translated, plus proof that the person signing has authority to bind it.
Getting it in time
Plan for it as the first step, not the last. Where a closing date is fixed, the codice fiscale should be in hand before the preliminary contract is signed, not before the deed — because you will need it earlier than you think, including to open the account the funds will move through.
